The Party Wall Act of 1996 came into force on 1st July 1997 and it provides a statutory regime governing the relationship between adjoining owners and regulates certain building works carried on or near to the boundaries between adjoining properties. The Act covers both domestic and commercial properties.
The Act provides a structured approach and framework when one party wishes to undertake works that may affect his neighbour's buildings and land. Prior to work commencing the appropriate notices have to be served, surveyors appointed to represent both parties, records of condition taken, including photographs that are acknowledged an agreed by both parties prior to any works being commenced.
We have experience in guiding either parties through the maze of requirements within the Party Wall Act, looking after their best interests and ensuring that the works to be undertaken close to or against a boundary are legitimate and executed within the spirit of the legislation.
